Terms of Service

These Terms of Service ("Terms") govern your use of MemoryBook.wedding (the "Service"). By using the Service, you agree to these Terms.

1. Service Provider

2. Description of Service

MemoryBook.wedding is a digital wedding guestbook platform. Album owners (couples) can create albums and invite guests to leave messages, photos, and videos. The Service operates online and is delivered as digital content.

3. Definitions

  • Owner: the person who creates and pays for an album
  • Guest: anyone invited by the Owner to contribute to an album
  • Album: a digital memory book containing guest contributions
  • Consumer: a natural person using the Service for purposes not related to their business

4. Account Creation and PINs

  • To create an album, you must provide a valid email address
  • Each album is protected by two PINs: a guest PIN (for posting) and an owner PIN (for management)
  • You are responsible for keeping your owner PIN secure
  • We are not liable for damages caused by sharing the owner PIN

5. Pricing and Payment

  • The current price is 149 PLN (Polish customers, VAT included) or 39 EUR (international customers)
  • The price is one-time and includes 12 months of album hosting from the event date
  • Optional add-ons: extended storage and annual hosting renewals
  • Payment is processed by Stripe; we do not store payment card details
  • VAT invoices are issued automatically for Polish customers

6. Right of Withdrawal (Consumers)

Under the Polish Consumer Rights Act (Ustawa o prawach konsumenta), Consumers have the right to withdraw from a distance contract within 14 days without giving a reason.

Important: The Service is digital content delivered before the end of the 14-day withdrawal period. By completing your purchase and clicking "I agree," you:

  1. Explicitly consent to immediate performance of the contract before the withdrawal period ends, and
  2. Acknowledge that you lose the right of withdrawal once delivery begins.

If you have not yet activated your album, you may withdraw within 14 days by emailing [email protected]. We will refund the full amount within 14 days using the same payment method.

7. User Responsibilities

You agree to:

  • Provide accurate information
  • Not upload inappropriate, offensive, or illegal content
  • Not share PINs with unauthorized people
  • Not attempt to bypass security measures or access other albums
  • Respect intellectual property rights of others
  • Respect other users and the couple

8. Prohibited Content

The following content is strictly prohibited:

  • Hate speech, harassment, or discrimination
  • Sexually explicit or pornographic content
  • Violence, gore, or shock content
  • Copyrighted material without permission
  • Spam, advertisements, or commercial solicitations
  • Malware, viruses, or harmful code
  • Content violating applicable law

9. Content Moderation

  • Album Owners can hide or delete any greeting in their album
  • We reserve the right to remove content that violates these Terms
  • We may suspend or terminate accounts for repeated violations
  • Removed content is not recoverable

10. Intellectual Property

  • Your content: you retain all rights to content you upload. By uploading, you grant us a non-exclusive, royalty-free license to store, display, and process your content solely to provide the Service.
  • Our content: the Service, including its design, code, and trademarks, is our property. You may not copy, modify, or redistribute it without permission.

11. Service Availability

  • We aim for 99% uptime but do not guarantee uninterrupted Service
  • We may perform maintenance with reasonable notice
  • We are not liable for temporary unavailability due to force majeure, third-party outages, or factors beyond our control

12. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • Nothing in these Terms limits liability for damages caused by intent or gross negligence, or any other liability that cannot be excluded under Polish law

13. Complaints

If you have a complaint about the Service:

  1. Email [email protected] with details
  2. We will respond within 14 days
  3. If unresolved, you may use the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
  4. You may also seek mediation through the Polish Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) or the Permanent Consumer Arbitration Court (Stały Polubowny Sąd Konsumencki)

14. Account Termination

  • You may delete your account at any time by emailing us
  • We may terminate accounts for violations of these Terms with reasonable notice
  • Upon termination, your album and data will be deleted within 30 days (except where retention is required by law)

15. Changes to These Terms

  • We may update these Terms by notifying you at least 14 days in advance by email
  • Continued use of the Service after changes take effect constitutes acceptance
  • If you do not accept the changes, you may terminate your account and request a pro-rata refund

16. Governing Law and Jurisdiction

  • These Terms are governed by Polish law
  • For Consumers, jurisdiction is determined by general rules under Polish civil procedure (you may sue in your local court)
  • For non-Consumer disputes, the courts competent for Szczecin, Poland have exclusive jurisdiction
